When creating an account, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
The Service is intended for business use. You represent that you have the authority to bind your organization to these Terms.
You must notify us immediately of any unauthorized access or security breach. We are not liable for any loss resulting from unauthorized use of your account.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.
We offer a 7-day free trial for new users. No credit card is required to start the trial. At the end of the trial, you must select a paid plan to continue using the Service.
We offer two subscription tiers: Standard ($699/month with 1,000 calls) and Custom (contact sales for multi-location, high-volume, or white-label needs). Plan details are available on our pricing page.
Subscriptions are billed monthly in advance. Payment is processed through our third-party payment processor (Stripe). You authorize us to charge your payment method for all fees incurred.
The Standard plan includes 1,000 calls per month. Custom plans have negotiated limits. If you exceed your plan's limit, overage charges may apply. We will notify you before you reach your limit.
You may upgrade or downgrade your plan at any time. Upgrades take effect immediately, while downgrades take effect at the start of your next billing cycle.
You may cancel your subscription at any time from your account dashboard. Cancellations take effect at the end of your current billing period. No refunds are provided for partial months.
We may change our pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

Message and data rates may apply based on your mobile carrier's plan. AVRYai does not charge for text messages, but your carrier's standard rates apply.

Our Service records and transcribes phone calls for quality assurance, training, and service improvement. By using the Service, you consent to call recording. You are responsible for complying with applicable call recording laws in your jurisdiction.
You retain ownership of all data you upload to the Service. You grant us a limited license to use, store, and process your data solely for the purpose of providing the Service.
We implement industry-standard security measures to protect your data. However, no system is completely secure, and we cannot guarantee absolute security.
The Service, including all software, designs, text, graphics, logos, and other content, is owned by AVRYai and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
You retain all rights to the content you provide to the Service. By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and process your content solely for the purpose of providing the Service.
If you provide feedback, suggestions, or ideas about the Service, we may use them without any obligation to compensate you.
The Service integrates with third-party services (e.g., Google Calendar, Salesforce, Stripe). Your use of these integrations is subject to the third party's terms and conditions. We are not responsible for third-party services or their availability.
We use AI services from Anthropic (Claude AI), ElevenLabs (voice synthesis), and Deepgram (speech recognition). These providers' terms and privacy policies also apply to your use of the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not warrant the accuracy or reliability of any information provided through the Service.
AI-generated responses may contain errors or inaccuracies. You are responsible for reviewing and verifying all information before relying on it.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVRYAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless AVRYai, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

You agree to resolve disputes with us on an individual basis and waive any right to bring or participate in class action lawsuits or class-wide arbitration.
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and AVRYai regarding the Service.
We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or internet service provider failures.
